Forensic science and its influence on policing and the criminal justice system have increased since the beginning of the twentieth century. While the philosophies of the forensic science pioneers remain the pillar of modern practice, rapid advances in technology and the underpinning sciences have seen an explosion in the number of disciplines and tools. Consequently, the way in which we exploit and interpret the remnant of criminal activity are adapting to this changing environment. In order to best exploit the trace, (...) an interdisciplinary approach to both research and investigation is required. In this paper, nine postdoctoral research fellows from a multidisciplinary team discuss their vision for the future of forensic science at the crime scene, in the laboratory and beyond. This article analyzes the demarcations made within psychology as a feature of the “memory wars”—the current controversy around “recovered” or “false” memory. As it is played out inside professional psychology, the dispute features clinical practitioners acting largely as proponents of recovered memory and experimentalists as proponents of false memory. Tracing a genealogy of this dispute back to a pair of original sites, we show how the traditions’engagement in three modes of scientific demonstration varies systematically in terms of the modes of (...) social relation inherent in their epistemic practices and the kinds of “reliable witness” these practices produce. We conclude that whereas the experimentalist tradition is able to transporttheir produced witnesses from oneto anothersite of demonstration with relative ease, the clinical tradition has much greater difficulty in doing so and thus has to engage in a variety of compensatory demonstrative strategies. Ethical climate (EC) has been broadly described as how well institutions respond to ethical issues. Developing a tool to study and evaluate EC that aims to achieve sustained improvements requires a contemporary framework with identified relevant drivers. An extensive literature review was performed, reviewing existing EC definitions, tools and areas where EC has been studied; ethical challenges and relevance of EC in contemporary paediatric intensive care (PIC); and relevant ethical theories. We surmised that existing EC definitions and tools designed to (...) measure it fail to capture nuances of the PIC environment, and sought to address existing gaps by developing an EC framework for PIC founded on ethical theory. In this article, we propose a Paediatric Intensive Care Ethical Climate (PICEC) conceptual framework and four measurable domains to be captured by an assessment tool. We define PICEC as the collective felt experience of interdisciplinary team members arising from those factors that enable or constrain their ability to navigate ethical aspects of their work. PICEC both results from and is influenced by how well ethical issues are understood, identified, explored, reflected on, responded to and addressed in the workplace. PICEC encompasses four, core inter-related domains representing drivers of EC including: (1) organisational culture and leadership; (2) interdisciplinary team relationships and dynamics; (3) integrated child and family-centred care; and (4) ethics literacy. Future directions involve developing a PICEC measurement tool, with implications for benchmarking as well as guidance for, and evaluation of, targeted interventions to foster a healthy EC. (shrink)

Measuring outcomes using quantitative analytic methods is the hallmark of scientific research in healthcare. For clinical ethics support services (CESS), tangible outcome metrics are lacking and literature examining CESS quality is limited to evaluation of single cases or the influence on individual healthcare professional’s perceptions or behaviour. This represents an enormous barrier to implementing and evaluating ethics initiatives to improve quality. In this context, Kok _et al_ propose a theoretical framework for how moral case deliberation (MCD) can drive quality at (...) an organisational-level, termed _morisprudence_ 1. By offering mechanistic insights into how MCD can lead to organisational learning and quality improvement (QI), they provide a roadmap for actionable items to measure quality. As conceptualised, _morisprudence_ follows accumulation of organisational practical wisdom from a repertoire of ‘paradigmatic’ MCDs, aiding identification of patterns of morally important features. Wicked problems’ are tricky to solve because of their many interconnected components and a lack of any single optimal solution. At the science–policy interface, all problems can look wicked: research exposes the complexity that is relevant to designing, executing and implementing policy fit for ambitious human needs. Expertise in philosophical research can help to navigate that complexity.

The return of genetic research results after death in the pediatric setting comes with unique complexities. Researchers must determine which results and through which processes results are returned. This paper discusses the experience over 15 years in pediatric cancer genetics research of returning research results after the death of a child and proposes a preventive ethics approach to protocol development in order to improve the quality of return of results in pediatric genomic settings.

Over the years, Katie Cannon's students referred to her work in progress as "Katie's canon." Not only does this book represent the canon of Cannon's best work; the book itself directly addresses the issues of canon formation and canon reformation. Cannon canonizes a literary tradition and directly addresses both oppression and liberation of African American women. Now in an expanded 25th-anniversary edition, Katie's Canon still packs firepower.

Nature contact has associations with emotional ill-being and well-being. However, the mechanisms underlying these associations are not fully understood. We hypothesised that increased adaptive and decreased maladaptive emotion regulation strategies would be a pathway linking nature contact to ill-being and well-being. Using data from a survey of 600 U.S.-based adults administered online in 2022, we conducted structural equation modelling to test our hypotheses. We found that (1) frequency of nature contact was significantly associated with lesser emotional ill-being and greater emotional (...) well-being, (2) effective emotion regulation was significantly associated with lesser emotional ill-being and greater emotional well-being, and (3) the associations of higher frequency of nature contact with these benefits were partly explained via emotion regulation. Moreover, we found a nonlinear relationship for the associations of duration of nature contact with some outcomes, with a rise in benefits up to certain amounts of time, and a levelling off after these points. These findings support and extend previous work that demonstrates that the associations of nature contact with emotional ill-being and well-being may be partly explained by changes in emotion regulation. We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. While the mainstreaming of the far right is attracting growing scholarly interest based on its contemporary relevance, the role that far-right self-representation strategies play in this process has seen limited engagement. In this article, we argue that far-right actors employ a post-fascist logic to bring their ideas closer to the mainstream. This logic rests on a dual message, whereby they attempt to outwardly distance themselves from fascism while at the same time recontextualising fascist ideas. To explore these dynamics, we use (...) a mixed-methods approach to discourse analysis to examine far-right social media posts during the 2022 Italian general election. Taking all Facebook, Instagram and Twitter posts during the official campaigning period from the party and leader accounts of Lega per Salvini Premier and Fratelli d’Italia, we explored articulations of the post-fascist dyad within this context. Our findings underscore how both far-right parties ridiculed accusations of fascism and depicted themselves as ‘centre-right’, yet they commonly used fascist dog-whistles and violent anti-immigration discourse to construct a broader conspiracy narrative and portray themselves as Italy's saviour. While Italy proves a paradigmatic case, this research has wider implications for the need to explore the relationship between self-representation and mainstreaming. (shrink)

KATIE McSHANE | : Taking the Fifth Assessment Report of the Intergovernmental Panel on Climate Change as representative, I argue that animal ethics has been neglected in the assessment of climate policy. While effects on ecosystem services, biodiversity, and human welfare are all catalogued quite carefully, there is no consideration at all of the effects of climate change on the welfare of animals. This omission, I argue, should bother us, for animal welfare is not adequately captured by assessments of (...) ecosystem services, biodiversity, or human welfare. After describing the paper’s assumptions and discussing the role of the IPCC’s Assessment Reports in climate policy, I consider the presentation of climate impacts in the IPCC’s Fifth Assessment Report, noting the aspects of animal welfare that are considered there, and comparing the report’s treatment of animal welfare to its treatment of human welfare. Next, I argue that the concepts of ecosystem services, biodiversity, and human welfare do not adequately capture the welfare of animals. Finally, I discuss concerns about human responsibility for animal welfare and the practicality of including considerations of animal welfare among the climate impacts studied by the IPCC. | : En prenant le Cinquième Rapport d’évaluation du Groupe d’experts intergouvernemental sur l’évolution du climat à titre de cas représentatif, je soutiens que l’éthique animale a été négligée dans l’évaluation de la politique climatique. This study examines the case of community resource mobilization within the context of a farmers market incentive program in Washington D.C., USA to illustrate the ways in which providing opportunities for people impacted by food inequities to develop and lead programming can help to promote food access. Through an analysis of interviews with 36 participants in the Produce Plus program, some of whom also served as paid staff and volunteers with the program, this study examines the ways that group-level social (...) interactions among program participants helped to ensure the program was accessible and accountable to the primarily Black communities that it serves. Specifically, we explore a particular set of social interactions, which we collectively term social solidarity, as a community-level form of social infrastructure that program volunteers and participants mobilized to support access to fresh, local food in their communities. We also examine the elements of the Produce Plus program that contributed to the flow of social solidarity within the program, providing insight into the ways in which the structure of food access programs can serve as a social conduit to facilitate or hinder the mobilization of community cultural resources like social solidarity. This article considers the meanings attached to refugeehood, repatriation and liberal citizenship in the twentieth century. Refugees are those who have been unjustly expelled from their political community. Their physical displacement is above all symbolic of a deeper political separation from the state and the citizenry. ‘Solving’ refugees’ exile is therefore not a question of halting refugees’ flight and reversing their movement, but requires political action restoring citizenship. All three ‘durable solutions’ developed by the international community in the twentieth century (...) – repatriation, resettlement and local integration – are intended to restore a refugee's access to citizenship, and through citizenship the protection and expression of their fundamental human rights. Yet repatriation poses particular challenges for liberal political thought. The logic of repatriation reinforces the organization of political space into bounded nation–state territories. However, it is the exclusionary consequences of national controls over political membership – and through this of access to citizenship rights – that prompt mass refugee flows. Can a framework for repatriation be developed which balances national state order and liberal citizenship rights? This article argues that using the social contract model to consider the different obligations and pacts between citizens, societies and states can provide a theoretical framework through which the liberal idea of citizenship and national controls on membership can be reconciled. Historical evidence suggests that the connections in practice between ideas of citizenship and repatriation have been far more complex. In particular, debate between Western liberal and Soviet authoritarian/collectivist understandings of the relationship between citizen and state played a key role in shaping the refugee protection regime that emerged after World War II and remains in place today. Repatriation – or more accurately liberal resistance to non-voluntary refugee repatriation – became an important tool of Cold War politics and retains an important value for states interested in projecting and reaffirming the primacy of liberal citizenship values. Yet the contradictions in post-Cold War operational use of repatriation to ‘solve’ displacement, and a growing reliance on ‘state-building’ exercises to validate refugees’ returns demonstrates that tension remains between national state interests and the universal distribution of liberal rights, as is particularly evident when considering Western donor states’ contemporary policies on refugees and asylum. For both intellectual and humanitarian reasons there is therefore an urgent need for the political theory underpinning refugee protection to be closely examined, in order that citizenship can be placed at the centre of refugees’ ‘solutions’. ☆ The article is based on a paper given at a workshop on Citizenship organized by the Centre for History and Economics and held at Robinson College, Cambridge on 14–15 July 2008. Older adults were considered a vulnerable group for the COVID-19 infection and its consequences, including problems with sleep.AimTo evaluate the prevalence of sleep disorders in older adults, to describe their sleep patterns, as well as to analyse if there were any changes in comparison with the period pre-pandemic.Materials and MethodsOnline survey used for data collection received answers from 914 elderly age range 65–90 years, from April to August 2020. Results: 71% of the sample reported a pre-existent sleep disorder, and some (...) of them worsened during the pandemic, especially Insomnia in women and Obstructive Sleep Apnea in men. No difference in sleep duration before and during the pandemic was found, although there was a worsening of some aspects related to sleep, such as sleep quality, sleep efficiency, awakening quality, sleep latency and nocturnal awakenings, especially in the female gender. Educational level influenced sleep latency, indicating higher sleep latency among those with primary education when compared with the ones with Ph.D.ConclusionThe pandemic had influenced sleep patterns among the elderly, as well as worsening of pre-existent sleep disorders. Female gender and low educational level were considered risk factors for sleep alterations, and high educational level, on its turn, appeared to be a protective factor. (shrink)

This essay asks: How do the realities of embodied trauma inflicted by racism interface with virtue theory? This question illuminates two lacunae in virtue theory. The first is attention to race. We argue that the contemporary academic virtue literature performs largely as a White space, failing to address virtue theory’s role in the social construction of race, ignoring the rich and vibrant resources on virtue ethics alive within the Black theological tradition that long antedates Alasdair MacIntyre’s After Virtue, and segregating (...) the emerging literature on race and virtue from the broader discourse. The second is lack of attention to embodiment. More precisely, contemporary virtue theory, informed largely by Aristotle, Aquinas, and MacIntyre, has no conceptual space to theorize the body’s role acquiring and deploying virtue and vice. To explore this nexus, we draw on racial trauma therapist Resmaa Menakem, Katie Walker Grimes, and Howard Thurman’s Jesus and the Disinherited to challenge contemporary virtue theory and open new possibilities for a robustly corporate, enfleshed theological virtue ethic. This article is about the special, subjective concepts we apply to experience, called “phenomenal concepts”. They are of special interest in a number of ways. First, they refer to phenomenal experiences, and the qualitative character of those experiences whose metaphysical status is hotly debated. Conscious experience strike many philosophers as philosophically problematic and difficult to accommodate within a physicalistic metaphysics. Second, PCs are widely thought to be special and unique among concepts. The sense that there is something special about PCs (...) is very closely tied up with features of the epistemic access they afford to qualia. When we deploy phenomenal concepts introspectively to some phenomenally conscious experience as it occurs, we are said to be acquainted with our own conscious experiences. Accounts of PCs either have to explain the acquaintance relation, or acquaintance with our phenomenal experiences has to be denied. PCs have received much attention in recent philosophy of mind mainly because they figure in arguments for dualism and in physicalist responses to these arguments. The main topic of this paper is to explore different accounts of phenomenal concepts and their role in recent debates over the metaphysical status of phenomenal consciousness. (shrink)

This paper addresses the stalemate on the question whether biodiversity has intrinsic value. I distinguish between a “weak” conception and two “strong” conceptions of intrinsic value in the environmental ethics literature. The strong conceptions of intrinsic value are connected, respectively, to moral standing and to a strongly objectivist account of value. Neither of these forms of value likely applies to biodiversity. However, the weak conception of intrinsic value is neutral about both moral standing and the nature of value and plausibly (...) applies to biodiversity. In addition, weak intrinsic value avoids common objections to the claim that biodiversity is intrinsically valuable. I develop a cumulative argument showing that environmentalists should presume that biodiversity has intrinsic value in the weak sense. (shrink)

The search for the statistical mechanical underpinning of thermodynamic irreversibility has so far focussed on the spontaneous approach to equilibrium. But this is the search for the underpinning of what Brown and Uffink have dubbed the ‘minus first law’ of thermodynamics. In contrast, the second law tells us that certain interventions on equilibrium states render the initial state ‘irrecoverable’. In this article, I discuss the unusual nature of processes in thermodynamics, and the type of irreversibility that the second law embodies. (...) I then search for the microscopic underpinning or statistical mechanical ‘reductive basis’ of the second law of thermodynamics by taking a functionalist strategy. First, I outline the functional role of the thermodynamic entropy: for a thermally isolated system, the thermodynamic entropy is constant in quasi-static processes, but increasing in non-quasi-static processes. I then search for the statistical mechanical quantity that plays this role—rather than the role of the traditional ‘holy grail’ as described by Callender. I argue that in statistical mechanics, the Gibbs entropy plays this role. (shrink)

I develop an account of ecological role functions—the functions of species within ecosystems—which is informed by alternative regime phenomena in ecology. My account is a causal-role theory which includes a counterfactual sensitivity condition. The account tracks and explains a distinction ecologists make between functions and various activities which are not functions. My counterfactual sensitivity condition resolves the liberality problem often attributed to causal-role theories of function, while also illuminating the explanatory centrality of role functions within ecology.

Medical professionals regularly joke about their patients' problems. Some of these jokes are clearly wrong, but are all jokes wrong?

This study identified and described ethical problems encountered by physiotherapists in their practice and physiotherapists’ moral sensitivity in ethical situations. A questionnaire-based survey was constructed to identify ethical problems, and the Moral Sensitivity Questionnaire Revised version was used to measure moral sensitivity. Physiotherapists (n = 116) working in public health services responded to the questionnaire. Based on the results, most of the physiotherapists encounter ethical problems weekly. They concern mainly financial considerations, equality and justice, professionalism, unethical conduct of physiotherapists or (...) other professions and patients’ self-determination. The dimension of moral strength was emphasised in physiotherapists’ self-evaluations of their moral sensitivity. As a conclusion, ethical problems do occur not only at individual level but also at organisational and society level. Physiotherapists seem to have moral strength for speaking on behalf of the patient. Scarce resources make them feel insufficient but much could still be done to provide quality care in co-operation with other health-care professionals. (shrink)

In what sense are the special sciences autonomous of fundamental physics? Autonomy is an enduring theme in discussions of the relationship between the special sciences and fundamental physics or, more generally, between higher and lower-level facts. Discussion of ‘autonomy’ often fails to recognise that autonomy admits of degrees; consequently, autonomy is either taken to require full independence, or risk relegation to mere apparent autonomy. In addition, the definition of autonomy used by Fodor, the most famous proponent of the autonomy of (...) the special sciences, has been robustly criticised by Loewer. In this paper I develop a new account of autonomy following Woodward which I dub ‘generalised autonomy’ since it unifies dynamical, causal and nomic autonomy. Autonomy, on this account, can be partial: some lower-level details matter while others do not. To summarise: whilst the detailed lower level is unconditionally relevant, conditionalising on the higher-level facts renders some lower-level details irrelevant. The macrodependencies that the higher-level facts enter into — be they dynamical, causal or nomic — screen off the underlying microdetails. This account helps resolve an explanatory puzzle: if the lower-level facts in some way underpin the higher-level facts, why don’t the lower-level details matter more for the day-to-day practice of the special sciences? The answer will be: the facts uncovered by the special sciences are autonomous in my sense, and so practitioners of these special sciences need not study more fundamental sciences, since these underlying facts are genuinely irrelevant. This article explores the experiences of Latina lesbian migrants living in the United States. Drawing on in-depth interviews with 15 Latina lesbian migrants, I argue that Latinas' sexual, racial, and class identities are continuously shifting as the process of migration repositions them in a new system of racial inequality. Their sexual identities are altered as migrants often silence their lesbian existence when negotiating relationships with families of origin. Lesbianas establish borderland spaces for themselves where they gain sexual autonomy but where (...) their identities are in flux. These spaces are “imagined communities” because while lesbianas envision them to provide solidarity, in practice the borderlands are riddled with inequalities and tensions. Despite this, the borderlands allow lesbianas to develop a mestiza consciousness. (shrink)

Internet protocol development is a social process, and resulting protocols are shaped by their developers’ politics and values. This article argues that the work of protocol development poses barriers to developers’ reflection upon values and politics in protocol design. A participant observation of a team developing internet protocols revealed that difficulties defining the stakeholders in an infrastructure and tensions between local and global viewpoints both complicated values reflection. Further, Internet architects tended to equate a core value of interoperability with values (...) neutrality. The article describes how particular work practices within infrastructure development overcame these challenges by engaging developers in praxis: situated, lived experience of the social nature of technology. The ecosystem services argument is a highly publicised instrumental argument for protecting biodiversity. I develop a new objection to this argument based on the lack of a causal connection from global species losses to local ecosystem changes. I survey some alternative formulations of services arguments, including ones incorporating option value or a precautionary principle, and show that they do not fare much better than the standard version. I conclude that environmental thinkers should rely less on ecosystem services as a means (...) to defend biodiversity, and that attention should be focused on additional types of value which might be attributed to global biodiversity. The Bayesian maxim for rational learning could be described as conservative change from one probabilistic belief or credence function to another in response to newinformation. Roughly: ‘Hold fixed any credences that are not directly affected by the learning experience.’ This is precisely articulated for the case when we learn that some proposition that we had previously entertained is indeed true (the rule of conditionalisation). But can this conservative-change maxim be extended to revising one’s credences in response to entertaining propositions or (...) concepts of which one was previously unaware? The economists Karni and Vierø (2013, 2015) make a proposal in this spirit. Philosophers have adopted effectively the same rule: revision in response to growing awareness should not affect the relative probabilities of propositions in one’s ‘old’ epistemic state. The rule is compelling, but only under the assumptions that its advocates introduce. It is not a general requirement of rationality, or so we argue. We provide informal counterexamples. And we show that, when awareness grows, the boundary between one’s ‘old’ and ‘new’ epistemic commitments is blurred. Accordingly, there is no general notion of conservative change in this setting. In this paper, we develop a novel response to counterfactual scepticism, the thesis that most ordinary counterfactual claims are false. In the process we aim to shed light on the relationship between debates in the philosophy of science and debates concerning the semantics and pragmatics of counterfactuals. We argue that science is concerned with many domains of inquiry, each with its own characteristic entities and regularities; moreover, statements of scientific law often include an implicit ceteris paribus clause that restricts the (...) scope of the associated regularity to circumstances that are ‘fitting’ to the domain in question. This observation reveals a way of responding to scepticism while, at the same time, doing justice both to the role of counterfactuals in science and to the complexities inherent in ordinary counterfactual discourse and reasoning. Biocentric egalitarianism is the view that all living things share an equal fundamental moral status qua living things. In light of the well-known problems with past philosophical attempts to argue for this position, this paper proposes a way biocentric egalitarian claims might be understood and possibly vindicated. Relying on frameworks developed in recent discussions of the “basis of equality” in human-centered ethics, the paper argues that thinking of egalitarian claims as justified by (rather than as justifying) social ideals provides the (...) best way of understanding the basis of biocentric egalitarian claims in environmental ethics. The paper first reviews arguments for biocentric egalitarianism and their central flaws and proceeds to survey different models for justifying egalitarian claims among humans. The paper argues the Social Ideal approach to justification is the one most likely to be helpful to biocentric egalitarians. (shrink)
